Our guiding data privacy principles demonstrate our commitment to managing personal information carefully and responsibly at eMoney:

  1. Data Minimization – We limit our collection and processing of data to what is relevant and necessary to accomplish our business purposes. The majority of our products and services provide value through data analytics to identify connections and market advantages in high-level business data.
  2. Transparency – We are transparent about how we collect personal information. Our Policy explains who we are; how we collect, disclose, and use personal information; and how you can exercise your privacy rights.
  3. Purpose – We use the personal information we collect to deliver our products and allow our stakeholders to make informed decisions. We also use some types of personal information to promote our services through marketing and advertising. More details and additional purposes are set out in this Policy.
  4. Legal Compliance – At eMoney we prioritize privacy compliance and are committed to compliance with applicable privacy regulations.

This Policy explains how eMoney Advisor, LLC (“eMoney”, “we”, “us” or “our”) collects, uses, and discloses personal information obtained through the online software applications that we own and operate that link to this Policy; our websites, emoneyadvisor.com, and any subsequent site we may create (the “Sites”); our mobile applications; and our technology services (collectively, the “Services”).
We encourage you to read this Policy as well as the applicable eMoney Terms of Use upon accessing our Services, and revisit them from time to time so that you are aware of any updates.
By using our Site or by registering for any Services, you acknowledge that you have read and understand the terms of this Policy. If you do not agree with (i) this Policy, (ii) any revisions to this Policy, and/or (iii) any practices related to this Policy, please do not use, visit, register, or otherwise access any Services, and content contained on the Services.

Our Collection of Personal Information

“Personal information” means information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, to you.
The types of personal information we collect about you depend on how you interact with us and our Services. Generally, we collect the following categories of personal information:

  • Contact Information: such as name, address, phone number, and email address.
  • Demographic Information: such as date of birth.
  • Account Information: such as account username and password, security questions, and any information you place in the Vault.
  • Financial Information: such as investments, finances, spending, balances, budgets, and information collected from financial accounts linked to our Services.
  • Transaction Information: such as payment, transaction, account balance, deposit, and purchase information.
  • Event Information: such as webinar, eMoney Summit, or other event enrollment information.
  • Survey Information: such as responses to user experience inquiries.
  • Inquiry Information: such as the content of emails, texts, or chats with us and, where applicable, voice recordings from calls with us.
  • Employment Information: such as job title, employer, resume, work history, and references. California job applicants can find additional disclosures in our California Applicant Privacy Disclosures.
  • Device Information: including IP address, browser type, internet service provider, pages visited, operating system, user log and clickstream data, and time and date of visit.
  • Cookie Data: including usage and activity on our Sites and other interactions with our Services using cookies, web beacons, and other online tracking technologies.
  • Location Data: including your general geographic location based on your IP address.
  • Online Chat Information: Our Services may include online chat features to assist with answering questions and providing you with relevant information. When you participate in an interactive chat, either with a virtual or live agent, the contents of the chat may be captured and kept as a transcript. By using an online chat feature, you understand that our vendors may process the information obtained through the chat feature in order to provide services on our behalf.

Sources of Personal Information

We obtain personal information from the following sources:

  • Directly from you: We collect personal information directly from you when you submit personal information to the Services, contact us through our webforms, or otherwise directly provide us with your personal information.
  • Automatically through our Services: We use technologies to automatically collect certain information about you and your devices when you use the Services, as further described in the Cookies and Online Tracking Technologies section below.
  • Business Partners: Our business partners, such as our corporate affiliates, and your professional advisors and service providers (e.g., advisors, attorneys, estate planners, and any other service provider you may retain or engage with) may collect personal information and share some or all of this information with us. For example, in some instances we receive data feeds based on potential or integrated service offerings at the direction of a user. We also collect personal information from business partners involved in the administration of 401(k) plans, such as plan sponsors (employers), financial professionals, plan administrators, custodians, and recordkeepers, or those who are involved in providing you a financial service or product. We may collect personal information from these parties in order to help financial professionals provide our Services to you.
  • Service Providers, Vendors, and Contractors: Our service providers, vendors, and contractors, such as payment processors and analytics providers, collect personal information on our behalf through the Services. For example, we receive usage analysis data to improve and expand our services.
  • Advisors: Financial advisors, broker-dealers, registered investment advisors, third-party administrators, trust companies, family offices, and other entities (each an “Advisor”) use eMoney’s Wealth Management System for the purpose of providing financial planning services to customers. Advisors collect personal information from their customers and input that information into our Services. The information typically concerns customers, their finances, and their family, including name, address, phone number, and financial information.
  • Financial Institutions: At the direction of a customer, financial institutions may share certain financial account information and transaction information of that customer with us. For example, when a customer opts-in to link his or her investment account to our Services, that financial institution will share the account information with us so we can provide the customer with an aggregated view of their financial information (this is called our “Connections” feature).
  • Publicly Available Sources: If you have registered for our Services, from time to time we may obtain additional personal information about you, such as address change information, from publicly available sources to keep our records current.
  • Other Users: We may collect personal information about you from other users. For example, a spouse may link a joint bank account to our Services, which would share with us financial information about the other spouse.
  • Social Media: If you choose to interact with us on social media, we may collect personal information about you from your social media account that you make public or share. We use personal information collected in connection with your social media account to communicate with you and better understand how you use our Services.
    Your Employer: If the Services are provided from or through your employer, your employer may provide us with personal information in order for us to provide the Services to you and your employer.

We may combine personal information that we receive from different sources.

Our Use of Personal Information

We use your personal information for the following purposes:

To Provide Products and Services:

  • Provide services, including maintaining or servicing accounts, providing customer service, processing or fulfilling orders and transactions, verifying customer information, processing payments, providing financing, providing advertising or marketing services, and providing analytic services.
  • Enable your activity within our Services and provide the Sites and Services to you generally, including to develop, enhance, and improve our Sites, Services, and your experience.
  • Register you for our Services and create your account with us.
  • Enable you to use our Services, including to complete the onboarding process, receive coaching or training from us, or create financial plans.
  • Deliver services you request, such as adding features or new functionality to the Sites and Services and providing customer service and technical support.
  • Register you for webinars, events, and conferences.
  • Enable single sign-on (SSO) functionality and allow you to securely log in to several Services at once.

To Communicate with You:

  • Communicate with you and tell you about our current and future services, and offer you third-party products and services we think you may find useful.
  • Obtain your feedback in order to improve your experience with our Sites and Services, including through optional surveys.
  • Communicate with you about and facilitate new contests, promotions and rewards, and upcoming events.
  • Provide you with news about products and services offered by us and our business partners and other relevant opportunities.

For Analytics and Personalization:

  • Provide you with a customized user experience.
  • Display advertising tailored to your interests, including marketing of our services. You may opt out of marketing communications at any time.
  • Link or combine with third-party information to understand your needs and customize offerings.

For Security and Fraud Prevention:

  • Detect, investigate, and prevent malicious, deceptive, fraudulent, or illegal activity.
  • Enable SSO functionality and secure login across services.
  • Enhance the security of our Sites and Services and defend against cyber threats.
  • Protect your personal information using federal law-compliant security measures. Note: No system is completely secure; avoid sending sensitive information over unsecure channels.

To Fulfill Our Legal Obligations:

  • Comply with legal or regulatory obligations, establish/exercise our rights, and defend against legal claims.

To Perform Core Business Functions:

  • Provide and maintain functionality of our Sites and Services.
  • Review and improve the quality and scope of our Services.
  • Enforce contracts and agreements.
  • Conduct internal operations including research, innovation, testing, monitoring, risk management, and administration.
  • Perform internal research and development activities.
  • Verify and maintain the quality or safety of our products and services.
  • Perform routine data backups and prepare for disaster recovery.
  • Coordinate with business partners to market their products/services to you.
  • Process and deliver contest entries and rewards.
  • Conduct research and surveys to improve our and our partners’ offerings.

Our Disclosure of Personal Information

We disclose personal information in the following ways:

  • Within eMoney: eMoney discloses personal information within eMoney and with our corporate affiliates for purposes and uses consistent with this Policy. For example, we may disclose your contact information to facilitate communication between you and an eMoney customer service representative.
  • Business Partners: We may disclose personal information to business partners for research, academic, marketing, and/or promotional purposes. We share your personal information with various parties so they can provide services to you, such as administering your 401(k) plan effectively, and so we can improve our services. For example, our Services facilitate the relationship between you and the financial professional administering your 401(k) plan. As a result, the financial professional has access to most information you input into our Services. Your financial professional will not see your transaction-level data, however, unless you affirmatively opt in to that level of access. We may also disclose anonymized data regarding your assets, account balances, and general transaction information to Advisors and may also share demographic data that describe the average time spent using the Services and other similar statistics. We or our business partners may publicly report the statistical trends of the research or analysis, but only in a way that would not allow you or any other person to be identified.
  • Service Providers, Vendors, and Contractors: We engage service providers, vendors, and contractors to perform functions and services on our behalf and under our instruction to make our Services available to you. For example, we may disclose transaction information to our payment processors to facilitate your transaction. We also may disclose additional personal information to application functionality providers to enable them to provide the necessary hardware, software, networking, storage, and other services we use to operate our services and maintain a high-quality experience. We may disclose your information to service providers, vendors, and contractors that enable us to provide our Services and help us operate our business, including through website design, sending email communications, fraud detection and prevention, customer care, and performing analytics.
  • Corporate Business Transactions: We may take part in or be involved with a corporate business transaction, such as a merger, acquisition, joint venture, or financing or sale of company or parts of its assets or business. We disclose personal information to a third party during negotiation of, in connection with or as an asset in such a corporate business transaction. Personal information may also be disclosed in the event of insolvency, bankruptcy, or receivership.
  • Legal Obligations and Rights: We may disclose personal information:
    • in connection with the establishment, exercise, or defense of legal claims;
    • to comply with laws or to respond to lawful requests and legal process;
    • to protect the rights and property of us, our agents, customers, and others, including to enforce our agreements, policies, and terms of use;
    • to fulfill our contractual obligations;
    • to detect, suppress, or prevent illegal activities, fraud, or misuse of data;
    • to protect the health and safety of us, our customers, or any person; or
    • as otherwise required by applicable laws.
  • Consent: With your consent, or as directed by you or your authorized representative, we may disclose personal information about you to other third parties not described in this Policy.
    • For example, the eMoney Wealth Management System exists to facilitate the relationship between you and your Advisor. As a result, the Advisor has access to your account information and anything that you elect to share with your Advisor.
    • We also may share personal information with websites or services that you (or your Advisor on your behalf) have granted permission to access your eMoney account, such as financial institutions for purposes of facilitating our products and services.
    • We also facilitate your sharing of information with your people or businesses that you have authorized to view or access your personal information in the eMoney Wealth Management System, such as your banker, accountant, or attorney, referred to as “Alliance Partners”.

Cookies and Other Online Tracking Technologies

We and our vendors may use cookies, pixels, and other online tracking technologies (collectively, “Cookies”) to collect information about your interactions with the Services. These Cookies may collect device and usage information (such as the browser you are using, IP address, device identifier, length and time of visit, and pages visited) and details about how you interact with the Services (including clicks, cursor movement, scrolls, and keystroke activity).
We use this information for a variety of purposes, including to enable you to sign in to the Services, store your preferences and settings, analyze how the Services perform, track your interactions with the Services, deliver and tailor interest-based advertisements, develop inferences about you, combat fraud, and to fulfill other business purposes.
We contract with service providers to support the operation and performance of our Site, our chat functionality, and mobile applications as applicable, through session replay technologies to analyze your interactions and experiences with our Services, including the features you engage with, how you navigate, and your click/touch, movement, scroll, and keystroke activity to help us understand and analyze how visitors use our Services and to improve the Services. These technologies may collect the following types of information, among others: IP address; screen size; device type (unique device identifiers); browser information; geographic location; and preferred language. We may engage certain web analytics services (including Google Analytics and the Meta Pixel) to help us understand and analyze how visitors use the Services, help us administer and improve the quality of the Services, and serve ads on our behalf across the internet.
You may be able to manage your Cookie preferences, including to opt out of certain interest-based advertising, using the settings on your browser or mobile device. The following services or organizations also offer tools that you can use to limit or opt out of interest-based advertising:

  • Facebook: To change your settings with Facebook, log into your Facebook account and navigate to the Privacy Center here or review your Ad Preferences here.

  • Industry organizations: To opt out of interest-based advertising from companies that participate in the opt-out programs provided by the Digital Advertising Alliance, click here, or the Network Advertising Initiative, click here.
  • Do Not Track Signals: Your web browser may have settings that allow you to transmit a “Do Not Track” signal when you visit various websites or use online services. Like many websites, the Site is not designed to respond to “Do Not Track” signals received from browsers. To learn more about “Do Not Track” signals, visit allaboutdnt.com.

We do not control how third parties manage their opt-out processes. We are not responsible for the effectiveness of external parties’ opt-out programs, or the accuracy of their statements regarding their programs.

Your opt-out choice may apply only to the browser or device you are using when you opt out, so you should update your settings on each of your browsers and devices. If you opt out, you will still receive ads, but they may not be as relevant to you and your interests. Note that opting out of these types of technologies may result in certain online features not functioning properly.

We or our vendors may collect personal information about your online activities over time and across different devices and online properties when you use the Services.

Mobile Applications

We may disclose personal information to our affiliates, business partners, vendors, and other parties, as further described in the Our Disclosure of Personal Information section above. To the extent we provide these parties access to your personal information obtained through our mobile application, we require that they provide the same level of personal information protection as required by this Policy.

Except as otherwise permitted or required by applicable law or regulation, we will only retain your personal information for as long as necessary to fulfill the purposes we collected it for, including our internal operational and business purposes; as required to satisfy any legal, obligations; or as necessary to resolve disputes. If you no longer wish to provide your personal information through our mobile application, you may uninstall the mobile application from your device. Note that this action will not delete your user account or any information we previously collected via the mobile application, nor does it affect our personal information collection through our other Services.

Controlling Your Personal Information

At all times, you may choose whether or not to provide or disclose personal information to us. If you choose not to provide personal information, you may still visit parts of our Services, but you may be unable to access certain options, programs, and services we typically offer. If you choose to share personal information with us, we strive to maintain accurate records of your personal information. To correct or delete personal information we store, Advisors may contact eMoney Customer Service by email, customerservice@emoneyadvisor.com, or by phone, 1-888-362-8482. Customers may correct or delete certain account aggregation information by logging into the Services using their log-in credentials and making whatever changes and deletions they desire to the accounts they have established. All information may not be able to be corrected or deleted, and some information stored within the Services can only be changed or removed through the customer’s Advisor. Customers should contact their Advisor if they want to change or remove such information concerning them that is stored in the Services.

Communication Preferences

If you have opted-in to our marketing communications (or, where permitted by law, if you have provided us or we have obtained your contact information), we may send you email messages, direct mail offers, push notifications, or other communications regarding products or services depending on the method of communication selected. If you would like to opt out of receiving communications from eMoney, please contact us at unsubscribe@emoneyadvisor.com or follow the unsubscribe instructions included in each marketing email. Please note that even if you opt out of receiving the foregoing communications, we may still contact you in response to any “Contact Us” requests as well as for transactional and administrative purposes.

Disclosures for Visitors from Outside the United States

eMoney is based in the United States, and our Services are intended for people in the United States. If you access our Services from outside the United States, please be aware that personal information we obtain about you may be transferred to and processed in the United States or other jurisdictions outside your own, and may be accessed by the courts, law enforcement, and national security authorities in those jurisdictions. Please also be aware that the data protection laws and regulations that apply to personal information transferred to the United States or other countries may be different from the laws in your country. By using our Services or otherwise providing your personal information to us, you acknowledge and consent to the international transfer and processing of your personal information as described in this Policy. If you do not want your personal information transferred outside of the country where you are located, you should not access our Services or provide your personal information to us.

Children’s Privacy

Our Services are not directed to children under the age of 13. We do not intend to, or knowingly, collect personal information from children under the age of 13. If we learn that any personal information we collect has been provided by a child under the age of 13, we will promptly delete that personal information. A child’s parent or guardian may provide the child’s information to us as part of a household.

Third-party Websites

Our Services may contain links to third-party websites and include embedded content that are hosted by such third parties. We are not responsible for the privacy practices or the content of these other websites. These third parties may use web measurement and customization technologies (such as cookies) in conjunction with the provision of this content or functionality. If you use a link to another website or view an embedded video, you should consult the privacy policy for that website. We have no control over the information that is submitted to, or collected by, other websites and we are not responsible for the content of any linked site, or any link contained in a linked site, or any changes or updates to such websites, or any embedded video.

Changes to This Policy

We will update this Policy from time to time. When we make changes to this Policy, we will change the date at the beginning of this Policy to include the “Last Updated” date. If we make material changes to this Policy, we will notify you by email, as appropriate, to your registered email address, by prominent posting on our Services (such as by placing a conspicuous announcement of the new Policy on the Services or by presenting you with a web page containing an electronic copy of the Policy), or through other communication channels. All changes shall be effective from the date of publication unless otherwise provided in the notification. Your only remedy, if you do not accept the terms of this Policy, is to discontinue use of our Services.
